Terms & Conditions

By downloading, accessing, or using SmartNoter (the "Service"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a binding agreement between you and SmartNoter ("we", "us", or "our"). Your continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.

Account Registration: To access certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Accuracy: You agree to provide accurate, current, and complete information during registration and to keep it updated.

Guest Accounts: We may offer temporary guest accounts that are automatically cleaned up after 48 hours of inactivity. Guest content that is not upgraded to a registered account may be lost.

Account Security: Notify us immediately at talha@brevios.com if you suspect unauthorized access to your account.

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

Illegal Content: Uploading, storing, or sharing content that violates any applicable law or regulation.

Harmful Content: Uploading malware, viruses, or content designed to harm the Service, its users, or third parties.

Harassment: Using the Service to harass, threaten, defame, or discriminate against others.

Intellectual Property: Uploading content that infringes the intellectual property rights of others.

Abuse: Attempting to circumvent rate limits, access other users' accounts, or interfere with the Service's infrastructure.

Automated Access: Scraping, crawling, or using bots to access the Service beyond permitted limits without our prior written consent.

We reserve the right to suspend or terminate accounts that violate these rules.

SmartNoter provides AI-powered features including voice transcription, note polishing, document OCR, and an AI chat assistant.

Third-Party Processing: AI features are powered by Mistral AI. Note content you submit for AI processing is transmitted to and processed by Mistral's API in accordance with Mistral's privacy policy.

Output Accuracy: AI-generated content may occasionally contain errors, inaccuracies, or omissions. AI outputs are provided for informational purposes and are not a substitute for professional advice. You are responsible for reviewing and validating AI-generated content before relying on it.

Your Content: You retain ownership of your content. By using AI features, you grant us the limited right to process your content solely for the purpose of providing the requested features.

Input Monitoring: You must not submit content through AI features that violates these Terms or applicable law.

SmartNoter offers a free tier and paid subscription plans (Pro and Elite) with monthly and yearly billing options.

Billing: All payments are processed securely through Google Play Billing. We do not store or have access to your payment card details.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the current period ends.

Free Trial: A 7-day free trial is offered for new subscribers. At the end of the trial, you will be charged the applicable subscription fee unless you cancel before the trial ends.

Price Changes: We may adjust subscription prices. We will provide reasonable notice of any price changes. Price changes do not affect the current billing period.

Refunds: Refunds are handled in accordance with Google Play's refund policies. Please contact Google Play support for billing disputes.

Our IP: The Service, including its design, code, branding, logos, and documentation, is owned by SmartNoter and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

Your IP: You retain all rights to the notes and content you create with the Service. We do not claim ownership of your content.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.

The Service integrates with third-party services including Mistral AI (AI processing), MongoDB Atlas (data hosting), and Google Play (payments).

These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party providers, and your use of their services may be subject to their separate agreements.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI outputs will be accurate or complete. Any reliance on the Service or its outputs is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTNOTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability arising out of or related to these Terms shall not exceed the amount you paid us (if any) during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

By You: You may stop using the Service and delete your account at any time. Deleting your account will remove your notes and account data in accordance with our privacy policy.

By Us: We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we reasonably believe continued access poses a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including IP, disclaimer, and limitation of liability) will survive.

We may update these Terms from time to time. When we make material changes, we will notify you through the app and/or via email before the changes take effect.

Your continued use of the Service after the changes become effective constitutes your acceptance of the updated Terms.

The "Last Updated" date at the top of this page indicates when these Terms were last revised.

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which SmartNoter operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms shall be resolved through good-faith negotiations. If the dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
